In South Africa, vaping in the workplace is generally regulated similarly to smoking. The new Tobacco Products and Electronic Delivery Systems Control Bill aims to regulate the use of tobacco and vaping products, including in workplaces. This bill introduces strict regulations and penalties for non-compliance, aiming to protect public health by reducing exposure to second-hand smoke and vapor.

Employer Actions for Vaping in the Office

    1. Establish a Clear Policy: Employers should have a clear policy that outlines the rules regarding vaping in the workplace. This policy should be communicated to all employees and included in the employee handbook.
    2. Designate Vaping Areas: If the employer allows vaping, they should designate specific areas where employees can vape, similar to smoking areas. These areas should be well-ventilated and away from non-smoking employees.
    3. Enforce the Policy: If an employee is found vaping in the office, the employer should enforce the policy consistently. This might include:
      • Verbal Warning: For a first-time offense, a verbal warning might be appropriate.
      • Written Warning: For repeated offenses, a written warning should be issued.
      • Disciplinary Action: Continued non-compliance could lead to further disciplinary actions, up to and including termination, depending on the severity and frequency of the violations.
    4. Educate Employees: Employers should educate their employees about the health risks associated with vaping and the reasons behind the policy. This can help in gaining employee buy-in and compliance.
    5. Monitor Compliance: Regularly monitor and review the policy to ensure it is being followed and remains effective. Adjust the policy as needed based on feedback and changes in legislation.

By implementing these steps, employers can create a safer and more comfortable working environment for all employees.

Good luck with navigating the issue with your employer… (You are going to need it!)
