Cannot afford to travel to work!

In South Africa, your rights as an employee are protected by various labor laws. If you can’t afford to travel to work, here are some key points to consider:

  1. Employment Contract: Your employment contract should outline the terms and conditions of your employment, including the location of your workplace. If your employer changes the location, it may be considered a change in the terms and conditions of your employment.  If this is the case it may be a good idea to speak to a labour lawyer to assess the matter and if possible take the matter further.
  2. Basic Conditions of Employment Act (BCEA): This act requires employers to provide written details of the place of work at the commencement of employment. If your employer relocates, they should consult with you and consider the reasonableness of the new location.
  3. Compensation for Relocation: If your employer relocates and it significantly impacts your travel costs, you may be entitled to compensation. The reasonableness of the relocation and the impact on your expenses will be considered.
  4. Fair Labor Practices: The South African Constitution enshrines the right to fair labour practices. This includes ensuring that employees are not unfairly burdened by changes in their employment conditions.
  5. Dispute Resolution: If you believe your rights are being violated, you can seek assistance from the Commission for Conciliation, Mediation and Arbitration (CCMA) or the Department of Employment and Labour.
  6. Speak to your Employer:  Advise your employer of your situation.  They may be sympathetic and help find a solution.  If it means that you will need an increase, they may be able to give you a path to qualify for an increase.
